Terms and Conditions:
As a subscriber to any of our services you agree to the following terms
and conditions: To complete a formal application and supply the information
requested. To accept total responsibility at all times for the use of
any services provided by 5Star Net Limited. To pay the appropriate charges
stated on our website for the services to which you subscribe. Not to
use our internet services for any illegal or unlawful purpose including,
but not limited to, the uploading or transferring of any copyright files,
pictures or software without the permission of the copyright owner. Not
to in any way cause, or help to cause, the security or integrity of this
or any other computer system to be compromised. To maintain the security
of your account(s) by keeping your password secure and to change your
password(s) when requested to do so by 5Star Net Limited. To be a responsible
user of the Internet and to respect the privacy of other Internet users.
Not to send unsolicited email or advertising email to anyone. To regularly
and frequently remove your email from the mail server. We reserve the
right to remove email data in excess of 40 megabytes left on the mail
server. Not to hold 5Star Net Limited or our suppliers or resellers liable
to you or any other person for any indirect, special, incidental or consequential
damages of any character, including, but not limited to, damages for loss
of goodwill, work stoppage, computer failure or malfunction, or any other
commercial damages, even if 5Star Net Limited shall have been informed
of the possibility of such damages or for any claim by any other party.
That you will be liable for all costs relating to the collection of overdue
accounts, and any costs applicable to the services in which you have subscribed.
5Star Net Limited reserves the right to close accounts showing outstanding
balances without warning. The provisions of the Consumer Guarantees Act
1993 shall not apply to this contract where the subscriber uses the Internet
Services of 5Star Net Limited for the purpose of a business or where the
services acquired by the subscriber from 5Star Net Limited are of a kind
not ordinarily required for personal, domestic or household use. To indemnify
5Star Net Limited from any liability arising out of or in connection with
the provision of any services provided by 5Star Net Limited to the subscriber.
Where the subscriber is a limited liability company, in consideration
of 5Star Net Limited at the request of the shareholders of the Company
("shareholders") entering into this contract, the shareholders
of the Company jointly and severally unconditionally guarantee the performance
by the Company of it's obligations under this contract.
5Star Net Limited as part of this agreement will:
Utilize its best efforts to make all services available to subscribers
24 hours per day where this is reasonably possible. Take all reasonable
measures to restore the services offered as soon as reasonably possible
in the event of any system malfunction. We take no responsibility for
any consequential loss and 5Star Net Limited liability is limited to the
value of it's services provided. Monitor your usage of the system if necessary
for the purpose of ensuring your use of the system is in accordance with
the terms and conditions stated here. Ensure electronic mail is delivered
where this is reasonably possible. Inform you by email or by posting a
message in an appropriate location on our web site of any changes to any
charge for using the services to which you have subscribed.
5Star Net Limited reserves the right to:
Refuse the subscription to any services or terminate any services without
giving a reason for such refusal or termination. Terminate any or all
services that you have subscribed to if you violate any of the above conditions
to which you have agreed. Termination of this agreement for any reason
shall be without prejudice to the accrued rights of 5Star Net Limited.
Acceptance
As a subscriber to any of the services provided by 5Star Net Limited
you agree to accept the terms and conditions set out above and agree to
be bound by them.
Termination
You may terminate your account by giving 5Star Net Limited at least 30
days prior written notice of your intention to terminate your account.
You remain liable for any applicable charges incurred to the end of the
normal monthly billing period.
